1. Introduction

Welcome to TCGDex ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of the TCGDex application (the "App"), available on iOS and Android platforms, and any related services provided by TCGDex.

By downloading, accessing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Account Registration

To use certain features of the App, you may need to create an account. When you create an account, you agree to provide accurate, current, and complete information and to update this information to maintain its accuracy.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Guest Accounts: The App may allow you to create or use a "Guest" account without full registration. Please note that Guest accounts may be subject to deletion after 90 days of inactivity. Any data associated with a Guest account will be permanently lost upon deletion. We recommend creating a full account to ensure your data is preserved.

3. Subscriptions and Payments

TCGDex offers subscription services that provide access to premium features. All payments are processed through RevenueCat, a third-party payment processor.

Subscription details:

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can cancel your subscription at any time through your device's app store account settings
• No refunds will be issued for partial subscription periods
• Prices are subject to change with notice; any price changes will apply to billing cycles after the notice

4. User Content and Data Synchronization

You retain all rights to the content you upload to the App, including images of your Pokémon card collection. You grant us a non-exclusive, royalty-free license to use, store, and display your content solely for the purpose of providing the App's services to you.

Automatic Synchronization: The App automatically synchronizes your data with our servers during each session to ensure your collection is up-to-date across all your devices. By using the App, you consent to this automatic synchronization process. Please be aware that:

• Data synchronization requires an active internet connection
• Changes made while offline will be synchronized when you next connect to the internet
• In cases of conflicting changes between devices, the most recent changes typically take precedence
• The synchronization process helps maintain a backup of your data on our servers

5. Acceptable Use

You agree not to use the App to:

• Violate any laws or regulations
• Infringe on the intellectual property rights of others
• Attempt to gain unauthorized access to our systems or other users' accounts
• Upload malicious code or attempt to interfere with the proper functioning of the App
• Engage in fraudulent activities related to card trading or valuation

6. Intellectual Property

The App and its original content, features, and functionality are owned by TCGDex and are protected by international copyright, trademark, and other intellectual property laws.

Pokémon and Pokémon TCG are trademarks of Nintendo, GAME FREAK, Creatures Inc., and The Pokémon Company. TCGDex is not affiliated with, endorsed by, or associated with these companies.

7. Account Deletion and Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Account Deletion: You have the right to delete your account and all associated data at any time. To do so:

• Open the TCGDex app and navigate to Settings
• Select the "Account" section
• Tap on "Delete Account"
• Follow the confirmation steps to permanently delete your account and all associated data

Upon account deletion, we will permanently remove all your personal information and user content from our systems within 30 days, in accordance with our Privacy Policy. Please note that this action cannot be undone, and all your collection data, settings, and purchase history will be lost.

If you have an active subscription at the time of account deletion, you will need to cancel it separately through your device's app store settings to prevent future billing.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TCGDEX BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

10. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other means. Your continued use of the App after such modifications constitutes your acceptance of the revised Terms.

11. Governing Law

• To offset server costs and other operational expenses
• To enable us to provide many features of the app for free

TCGDex is committed to maintaining transparency about affiliate relationships, and we will never recommend products or services solely to generate commissions.

14. Data Retention and Inactive Accounts

In addition to our account deletion policy, please be aware of the following data retention practices:

• Guest Accounts: If you use a Guest account (an account without full registration), your account and all associated data may be automatically deleted after 90 days of inactivity.
• Inactive Accounts: We reserve the right to delete registered accounts that have been inactive for more than 12 consecutive months. We will attempt to notify you by email before such deletion.
• Synchronization: Each time you open the App, your data is automatically synchronized with our servers.
